Rubbish Removal St John's Wood Terms and Conditions

These Terms and Conditions set out the basis on which we provide rubbish removal and waste collection services in St John's Wood and surrounding areas. By booking a collection, requesting a quotation, or allowing our team to carry out any work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

Service means any rubbish removal, waste collection, waste clearance, bulky item collection, or related service provided by us.

Customer means the individual or business who requests or purchases the Service.

Premises means the property or location where the Service is to be carried out.

Waste means any items, materials, rubbish, junk, or debris that the Customer asks us to collect and remove, subject to the exclusions set out in these Terms and Conditions.

Contract means the agreement between the Customer and us for the provision of the Service, incorporating these Terms and Conditions.

2. Scope of Service

We provide a rubbish removal and waste collection service which includes the collection, loading, and transportation of Waste from the Premises to an authorised disposal or recycling facility. The exact scope of the Service, including the estimated volume, weight, and type of Waste, will be agreed with the Customer at the time of booking, quotation, or on arrival at the Premises, subject to inspection.

Our Service is provided for both domestic and commercial Customers. Certain types of Waste are restricted or prohibited, as set out in the Waste Regulations section of these Terms and Conditions.

3. Booking Process

3.1 The Customer may request a quotation or make a booking by telephone, email, or online form. Any quotation is based on the information provided by the Customer and is subject to amendment upon inspection of the Waste at the Premises.

3.2 A booking is only confirmed when we have accepted the request, agreed a collection date and time window, and communicated our acceptance to the Customer. We reserve the right to decline any booking at our discretion.

3.3 The Customer must provide accurate details of the Premises, access arrangements, parking restrictions, and the approximate volume and type of Waste. If the information supplied is incomplete or inaccurate, the price and timing of the Service may change, or we may be unable to complete the Service.

3.4 Time and date for collection are provided in good faith but are estimates only. While we make reasonable efforts to attend within the agreed time window, factors such as traffic, weather, and delays at previous jobs may affect arrival time. We will not be liable for minor delays, but we will aim to inform the Customer of any significant changes.

4. Quotations and Pricing

4.1 Quotations are usually based on estimated volume and type of Waste, accessibility, and distance from the vehicle. Final pricing may be adjusted on site once our team has inspected the Waste and confirmed the actual load size and nature of materials.

4.2 If, on arrival, the Waste is significantly more than described, or it includes items that are heavier, hazardous, or difficult to access, we may offer a revised price. The Customer may accept the new price or decline, in which case no Service will be carried out and, where applicable, a call-out fee may be charged.

4.3 All prices will be quoted in pounds sterling and may be subject to VAT or other applicable taxes. Any such charges will be made clear to the Customer before the Service is agreed.

5. Payments

5.1 Unless otherwise agreed in writing, payment is due on completion of the Service on the day of collection. We accept payment by cash, card, or other methods as notified to the Customer at the time of booking.

5.2 For business Customers or larger jobs, we may require a deposit or full prepayment prior to attendance. Any deposit terms will be confirmed at the time of booking.

5.3 If payment is not made when due, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs we incur in seeking payment, including administrative and legal costs.

5.4 Title to any Waste collected passes to us only upon full payment for the Service. Until payment is received, we may retain or return the Waste at our discretion, subject to applicable waste regulations.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by giving us notice by telephone or email. We ask for as much notice as possible so that we can manage our schedule efficiently.

6.2 If the Customer cancels more than 24 hours before the agreed collection time, no cancellation fee will usually apply, unless a special vehicle, additional labour, or specific arrangements have already been committed, in which case reasonable charges may apply.

6.3 If the Customer cancels within 24 hours of the scheduled collection, we may charge a cancellation fee to cover our costs and lost opportunity. The amount will be reasonable in the circumstances and notified to the Customer.

6.4 If, on arrival, we are unable to gain access to the Premises, the Waste is unavailable, or the Customer is not present where their presence is required and access has not been pre-arranged, we may treat this as a last-minute cancellation and charge an attendance or cancellation fee.

6.5 We reserve the right to cancel or reschedule the Service if we are unable to attend due to events beyond our reasonable control, including severe weather, road closures, accidents, or staff illness. In such cases, we will inform the Customer as soon as reasonably practicable and arrange a new collection time. We will not be liable for any loss arising from such cancellation or rescheduling.

7. Customer Obligations

7.1 The Customer must ensure safe and reasonable access to the Premises and to the Waste. This includes making sure that any gates, doors, stairways, hallways, lifts, or communal areas required for access are unlocked and cleared as necessary.

7.2 The Customer is responsible for ensuring that the Waste presented for collection is suitable for removal, is not hazardous or prohibited, and is free from sharp or dangerous objects that have not been properly identified or packaged.

7.3 The Customer must obtain any permissions, consents, or permits required for us to park and operate near the Premises, including any parking vouchers or visitor permits where applicable. Any parking fines or penalties incurred as a result of inaccurate information or failure to provide required permits may be charged to the Customer.

7.4 The Customer must not ask our staff to undertake work that falls outside the agreed Service or that may endanger the health and safety of our team, such as climbing on unsafe structures, removing asbestos, or handling uncontained clinical waste.

8. Waste Regulations and Prohibited Items

8.1 We operate in accordance with UK waste management legislation and duty of care requirements. Waste will be transported only to authorised facilities for disposal, recycling, or recovery, and we will take reasonable steps to maximise recycling where practical.

8.2 Certain items and materials are hazardous or controlled and cannot be collected as part of a standard rubbish removal service. These may include, but are not limited to, asbestos, clinical or medical waste, pressurised gas cylinders, certain chemicals, flammable liquids, large quantities of paint, and some electrical or electronic equipment requiring specialist handling.

8.3 If prohibited or hazardous items are discovered within the Waste, we reserve the right to refuse to collect them, to adjust the price to reflect specialist handling, or to cancel the Service if necessary. Any additional costs associated with dealing with such materials will be payable by the Customer.

8.4 The Customer is responsible for declaring any items which may be hazardous or require special treatment prior to our arrival. Failure to do so may result in additional charges, refusal of Service, or the need for a separate specialist collection.

8.5 We do not accept responsibility for any legal consequences arising from the Customer's failure to comply with applicable waste regulations when presenting materials for collection.

9. Limitation of Liability

9.1 We will exercise reasonable care and skill in providing the Service. However, our liability to the Customer is limited as set out in this section.

9.2 We will not be liable for any loss or damage which is not a reasonably foreseeable result of our breach of the Contract or our negligence. We do not accept liability for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of opportunity.

9.3 Our team will take reasonable care when moving Waste through the Premises. The Customer should move or protect any items of particular value or fragility before we arrive. Except where damage is caused by our negligence, we are not responsible for damage to driveways, flooring, fixtures, or fittings reasonably arising from the normal performance of the Service.

9.4 If we are found liable for any loss or damage, our total liability to the Customer, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable for the specific Service giving rise to the claim.

9.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other matter where liability cannot be lawfully excluded or limited.

10. Insurance

10.1 We maintain appropriate insurance cover in respect of our rubbish removal and waste collection activities. Details of our insurance can be made available to the Customer upon reasonable request.

10.2 The Customer is responsible for arranging any additional insurance they deem necessary in relation to their own property or business interruption.

11. Complaints and Dispute Resolution

11.1 If the Customer is dissatisfied with any aspect of the Service, they should notify us as soon as possible, providing full details of the issue so that we can investigate.

11.2 We will review any complaint promptly and aim to resolve it in a fair and reasonable manner, which may include a revisit to the Premises, partial refund, or other appropriate remedy depending on the circumstances.

11.3 If a dispute cannot be resolved informally, the parties agree to attempt to settle the matter through negotiation before considering formal legal proceedings.

12. Privacy and Data Protection

12.1 We will collect and use personal data provided by the Customer for the purposes of administering bookings, providing the Service, processing payments, and managing our relationship with the Customer.

12.2 Personal data will be handled in accordance with applicable data protection laws. We will take reasonable measures to keep such data secure and to prevent unauthorised access or disclosure.

13. Changes to These Terms

13.1 We may amend these Terms and Conditions from time to time to reflect changes in the law, our business practices, or the nature of the Service. Updated terms will be made available and will apply to any new bookings made after the date of the change.

13.2 The Terms and Conditions in force at the time of the Customer's booking will govern that particular Contract unless changes are required by law or with the Customer's express agreement.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any Contract between us and the Customer, are governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.2 No waiver by us of any breach of these Terms and Conditions shall be considered a waiver of any subsequent breach of the same or any other provision.

15.3 The Customer may not assign or transfer any of their rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations where this does not materially affect the Service to the Customer.

15.4 These Terms and Conditions constitute the entire agreement between the parties in relation to the Service and supersede any prior discussions, correspondence, or understandings.
